Terms of Service

These Terms of Service ("Terms") govern your access to and use of Oppvera (the "Service"), an educational simulation lab operated by Oppkey ("we," "us," or "our"). By creating an account, requesting access, or signing in, you agree to these Terms.
If you do not agree, do not use the Service.
1. Educational purpose
Oppvera is an educational site for learning how AI search and retrieval systems work. It is designed for training, experimentation, and demonstration—not as a production system for storing or processing your most sensitive business information.
You are responsible for deciding what content you upload or enter. Do not upload trade secrets, regulated personal data, credentials, or other information you cannot afford to expose on a shared educational platform.
2. No warranties; availability and changes
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO GUARANTEES REGARDING:
- Security — We have made reasonable efforts to secure the Service, but we do not warrant that the Service is secure, error-free, or free of unauthorized access.
- Uptime — The Service may go down without notice for maintenance, upgrades, outages, or other reasons.
- Continuity — Features, content, models, and workflows may change or be removed at any time as the educational product evolves.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
3. Acceptable use
You agree to use the Service only for lawful educational purposes related to understanding AI search behavior.
Prohibited conduct includes, without limitation:
- Any illegal activity or violation of applicable law.
- Using the Service to mislead, deceive, or manipulate AI systems in ways that violate platform policies, impersonate others, spread fraud, or misrepresent facts to the public.
- Using the Service to fool or game AI systems for harmful, deceptive, or non-educational ends. Oppvera exists to learn how AI search operates, not to train misuse.
- Attempting to breach security, probe vulnerabilities without authorization, scrape other users' data, or interfere with the Service.
- Harassment, abuse, or infringement of others' rights.
- Using Oppvera Watch (or any similar client) to record, automate, or monitor third-party AI products in ways that violate those products' terms of service, privacy policies, or applicable law.
We may suspend or terminate your access immediately, without refund or notice, if we believe you have misused the Service or violated these Terms.
4. Oppvera Watch (desktop client)
Oppvera Watch is an optional, open-source desktop application that pairs with a campaign to capture answers from signed-in consumer AI sites (for example ChatGPT.com or Claude.ai). It is separate from the hosted Oppvera web application but is offered as part of the overall learning experience.
You are solely responsible for how you install and use Oppvera Watch, including:
- Complying with the terms of service, privacy policies, and acceptable-use rules of every AI provider or website you choose to monitor or record.
- Ensuring you have the legal right to capture, store, and share session content you send to Oppvera.
- Deciding whether your use is permitted for your organization, clients, and jurisdiction.
We do not operate, endorse, or control third-party AI providers. We do not guarantee that using Oppvera Watch is permitted by any provider's policies. You assume all risk that your monitoring or capture activity may breach a third-party agreement or law.
By downloading Oppvera Watch or pairing it to a campaign, you agree that Oppkey is not liable for your provider-account choices or resulting claims, subject to Sections 9 and 10 below.
5. Account and access
Access is invite-only. You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account.
We may refuse, revoke, or limit access at our discretion to protect the Service, other users, or Oppkey.
6. Communications and contact authorization
When you register or request access with your email address, you authorize Oppkey to contact you regarding Oppvera. This authorization includes, but is not limited to:
- Notices about usage changes, feature updates, or policy revisions
- Requests for feedback on the educational experience
- Updates on availability of new educational material, labs, or training content
- Operational messages about your account or access status
You may opt out of non-essential marketing email where required by law; operational and account-related messages may still be sent.
7. Your content
You retain ownership of content you submit. You grant us a limited license to host, process, and display that content solely to operate the Service and provide the educational experience.
Because this is an educational environment, do not treat the Service as a secure archive for valuable or confidential business records.
8. Intellectual property
Oppvera, its software, documentation, branding, and educational materials are owned by Oppkey or its licensors. These Terms do not grant you ownership of the Service—only a limited right to use it as described here.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Oppkey AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE OR OPPVERA WATCH.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Oppkey from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service or Oppvera Watch, your monitoring or capture of third-party AI sessions, or your violation of these Terms or any third-party provider terms.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes may be communicated by email or in-product notice when practicable.
12. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles, except where mandatory local law applies.
